    These Terms of Service ("Terms") govern your access to and use of the LookupVIN website located at lookupvin.us, any related websites, applications, checkout pages, reports, content, and services we make available (collectively, the "Service"). LookupVIN is a website and service operated by FILINGS LLC. In these Terms, "LookupVIN," "we," "our," and "us" refer to FILINGS LLC and the Service branded as LookupVIN.

    By accessing or using the Service, creating an account, starting a trial, purchasing a report, subscribing, clicking a button or checkbox indicating acceptance, or otherwise using any report made available through the Service, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and any additional terms presented to you at the point of purchase or use. If you do not agree, do not use the Service.

    1. Eligibility

    You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

    2. Description of Service

    LookupVIN provides vehicle history reports and related vehicle-information products based on Vehicle Identification Numbers ("VINs") and other inputs. Reports may include, without limitation, data relating to title history, brands, odometer readings, salvage or total-loss records, lien information, theft information, auction records, ownership history, accident or damage information, recalls, specifications, and other vehicle-related information.

    Reports are compiled from third-party providers and public or private data sources, which may include ClearVin, NMVTIS, NVS, government agencies, insurance companies, auctions, recyclers, inspection services, and other data suppliers. Reports are provided for informational purposes only and are limited in scope.

    3. Important Report Limitations

    A vehicle history report is not a substitute for an independent vehicle inspection, title review, lien search, legal review, or any other due diligence you should perform before purchasing, selling, financing, insuring, transporting, or otherwise dealing with a vehicle.

    You acknowledge and agree that:

    • report data may be delayed, incomplete, unavailable, inconsistent, inaccurate, or outdated;
    • not every event involving a vehicle is reported to or captured by our data sources;
    • state title, branding, salvage, and reporting practices vary;
    • some sources do not report in real time;
    • the absence of a record does not mean the absence of a problem; and
    • you use any report at your own risk.

    You should independently verify material facts, including title status, liens, condition, mileage, structural integrity, prior damage, theft status, and eligibility for registration or insurance.

    4. Internal Use Only; Restrictions on Use of Reports

    All reports and report data made available through the Service are licensed, not sold, and may be used solely for your own internal use. For individual users, "internal use" means your own personal, non-commercial use. For business users, "internal use" means your own internal business evaluation purposes only, and not for resale, republication, distribution, or use for the benefit of third parties.

    Except as expressly permitted by us in writing, you may not:

    • sell, resell, license, sublicense, assign, transfer, distribute, disclose, publish, display, repost, or commercially exploit any report or report data;
    • provide reports or report data to any third party, including customers, leads, website visitors, affiliates, brokers, marketplaces, lenders, insurers, or dealers, except your own attorneys, accountants, or advisors who need access for your internal use and are bound by confidentiality obligations;
    • use any report or report data to create, supplement, verify, or power another product, service, dataset, listing, score, model, or database;
    • scrape, mine, harvest, export, bulk download, cache, mirror, spider, or systematically collect report data;
    • remove, obscure, or alter copyright notices, proprietary notices, trademarks, branding, disclaimers, or attributions;
    • reverse engineer, decompile, disassemble, or attempt to derive source materials, structure, or underlying datasets from the Service;
    • use the Service or any report in violation of any law, regulation, contract, or third-party right; or
    • use the Service or any report for any eligibility determination relating to credit, insurance, employment, housing, tenant screening, underwriting, licensing, or any other purpose governed by the Fair Credit Reporting Act or similar law.

    Any unauthorized use automatically terminates your license to use the Service and may violate copyright, trademark, contract, and other laws.

    5. ClearVin-Specific Terms

    To the extent any report, data, content, or functionality made available through the Service is powered by, sourced from, or otherwise provided by ClearVin or its affiliates, licensors, suppliers, or service providers (collectively, the "ClearVin Materials"), the following terms apply in addition to all other provisions of these Terms:

    5.1 Internal Use Limitation

    You acknowledge and agree that ClearVin Materials are made available solely for your internal use purposes and are not for resale, republication, redistribution, public display, external customer delivery, or other onward commercial exploitation.

    5.2 Assumption of Risk; Waiver and Release of Claims Against ClearVin

    To the fullest extent permitted by law, you knowingly and voluntarily assume all risks arising out of or related to your access to, use of, inability to use, or reliance on any ClearVin Materials. You further waive, release, and forever discharge ClearVin and its affiliates, licensors, suppliers, data providers, service providers, and each of their respective officers, directors, members, employees, contractors, agents, successors, and assigns from any and all claims, demands, causes of action, losses, damages, liabilities, judgments, costs, and expenses of every kind, whether known or unknown, arising out of or relating to the ClearVin Materials, including any alleged errors, omissions, interruptions, delays, inaccuracies, incompleteness, nonperformance, or reliance on any report data.

    Without limiting the foregoing, you agree that you will not seek to hold ClearVin liable for, or seek contribution, indemnity, reimbursement, or recovery from ClearVin for, any losses, claims, damages, or expenses arising out of or relating to your use of the Service or any report.

    Nothing in this Section limits any rights that cannot be waived under applicable law.

    5.3 Acknowledgement of ClearVin Intellectual Property

    You acknowledge and agree that, as between you and ClearVin, ClearVin owns all rights, title, and interest in and to the ClearVin Materials, including all associated intellectual property rights, copyrights, trademarks, service marks, logos, trade names, compilations, report formats, branding, and proprietary technology, together with all goodwill associated therewith. No rights are granted to you except the limited, revocable, non-exclusive right to access and use ClearVin Materials through the Service for internal use in accordance with these Terms.

    You agree not to copy, reproduce, modify, create derivative works from, rebrand, white-label, translate, frame, mirror, or otherwise exploit any ClearVin Materials except as expressly permitted in writing.

    5.4 Third-Party Beneficiary

    ClearVin and its affiliates, licensors, suppliers, and service providers are intended third-party beneficiaries of these Terms, including Sections 4, 5, 8, 9, 12, 13, 14, and 18, and may enforce those provisions directly against you.

    6. Accounts and Account Security

    You may be required to create an account to access some or all of the Service. You agree to provide accurate, current, and complete information and to keep it updated.

    You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials. You may not share your account or permit others to access the Service through your credentials. You must promptly notify us if you suspect any unauthorized access, compromise, or misuse of your account.

    We may suspend, limit, or terminate any account at any time if we reasonably believe account information is inaccurate, payment is delinquent, the account is being shared, or the account is being used in violation of these Terms.

    7. Subscriptions, Trials, Billing, and Payments

    Access to certain reports or features requires payment.

    If you enroll in a subscription, start a trial, or make a purchase, you authorize us and our third-party payment processors to charge your selected payment method for all applicable fees, taxes, and other charges in accordance with the pricing and plan terms presented at checkout.

    7.1 Trial Offer

    We may offer a 3-day trial for $1.00, which includes access to your first vehicle history report, if and when presented at checkout.

    7.2 Automatic Renewal

    Unless you cancel before the end of the trial period, your subscription will automatically renew at $29 per month or such other price disclosed to you at checkout or renewal notice, and we will continue to charge your payment method on a recurring basis unless and until you cancel.

    7.3 Cancellation

    You may cancel through your account settings or billing portal, or by contacting support, before the next renewal date. If you cancel during the trial, you will not be charged the monthly subscription fee. If you cancel after the trial or after a renewal, your cancellation will take effect at the end of the then-current billing period, and you will retain access until that period ends.

    7.4 Refunds

    Refunds, if any, are governed by our Refund Policy available at /refund and any non-waivable rights under applicable law.

    7.5 Failed Payments; Taxes; Price Changes

    If a charge is declined or cannot be completed, we may suspend access until payment is successfully processed. You are responsible for applicable taxes. We may change prices from time to time; where required by law, we will provide notice before a price change takes effect.

    8. Acceptable Use

    You agree not to misuse the Service. Without limitation, you will not:

    • use the Service for unlawful, fraudulent, deceptive, or harmful purposes;
    • use report data to harass, discriminate against, stalk, or injure any person;
    • interfere with or disrupt the integrity, security, performance, or availability of the Service;
    • introduce malware, viruses, bots, or harmful code;
    • attempt unauthorized access to accounts, systems, networks, or data;
    • evade technical or contractual usage restrictions;
    • use automated means to access the Service except as expressly authorized in writing; or
    • circumvent payment, rate limits, account limits, or geographic restrictions.

    9. Ownership of the Service; Intellectual Property

    The Service, including our website, software, text, graphics, branding, logos, interfaces, report layout, and all related content and materials, is owned by FILINGS LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

    Except for the limited right to use the Service in accordance with these Terms, no right, title, or interest is transferred to you. You may not copy, reproduce, distribute, modify, publicly display, create derivative works from, or otherwise exploit any part of the Service except as expressly permitted by these Terms or by prior written consent.

    10. Third-Party Services and Data Sources

    The Service may contain links to or integrations with third-party websites, tools, payment processors, authentication services, analytics tools, and data sources. We do not control and are not responsible for third-party services, content, policies, accuracy, or practices. Your use of third-party services is governed by their own terms and policies.

    11. Monitoring and Enforcement

    We may, but are not required to, monitor use of the Service for compliance with these Terms, investigate suspected misuse, and take any action we reasonably deem appropriate, including suspending or terminating access, removing content, refusing service, canceling orders, or cooperating with law enforcement or legal process.

    12. Disclaimer of Warranties

    To the fullest extent permitted by law, the Service, all reports, all report data, and all related content and materials are provided "as is" and "as available," with all faults, and without warranties of any kind, whether express, implied, statutory, or otherwise.

    Without limiting the foregoing, we disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, timeliness, quiet enjoyment, and any warranties arising out of course of dealing, course of performance, or usage of trade.

    We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any report will be complete, accurate, current, or sufficient for any particular purpose.

    13. Release

    To the fullest extent permitted by law, you release and discharge LookupVIN, FILINGS LLC, our affiliates, officers, directors, employees, contractors, agents, licensors, suppliers, data providers, and service providers from any and all claims, liabilities, damages, and demands arising out of or related to disputes between you and any seller, buyer, dealer, auction, lender, insurer, transporter, service provider, or other third party, or arising out of your reliance on any report or report data.

    14. Limitation of Liability

    To the fullest extent permitted by law, neither FILINGS LLC, LookupVIN, nor any of our affiliates, officers, directors, employees, contractors, agents, licensors, suppliers, or data providers shall be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, business, use, goodwill, data, or other intangible losses, arising out of or relating to the Service or these Terms, regardless of the theory of liability and even if advised of the possibility of such damages.

    To the fullest extent permitted by law, the total aggregate liability of FILINGS LLC, LookupVIN, and our affiliates, officers, directors, employees, contractors, agents, licensors, suppliers, and data providers for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the amount you paid us for the specific report, subscription, or service giving rise to the claim during the twelve (12) months before the event giving rise to liability; or (b) one hundred U.S. dollars (US $100).

    The limitations in these Terms are an essential basis of the bargain between you and us.

    15. Indemnification

    You agree to defend, indemnify, and hold harmless FILINGS LLC, LookupVIN, ClearVin, and each of their respective affiliates, officers, directors, employees, contractors, agents, licensors, suppliers, service providers, data providers, successors, and assigns from and against any and all claims, actions, demands, liabilities, damages, judgments, settlements, penalties, fines, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

    • your access to or use of the Service;
    • your violation of these Terms;
    • your misuse of any report or report data;
    • your violation of any law or third-party right; or
    • any dispute between you and any third party arising from your use of the Service.

    16. Suspension and Termination

    We may suspend, restrict, or terminate your access to all or any part of the Service at any time, with or without notice, if we believe you have violated these Terms, if payment fails, if required by law, or if necessary to protect the Service, our users, our rights, or third parties.

    Upon termination, all rights granted to you under these Terms immediately cease. Sections that by their nature should survive termination will survive, including Sections 4, 5, 9, 12, 13, 14, 15, 18, 19, 20, 21, Appendix A, and Appendix B.

    17. Electronic Communications; Electronic Assent

    You consent to receive communications from us electronically, including by email, posting on the Service, or through your account.

    You agree that your electronic acceptance of these Terms, including by clicking a checkbox, button, or similar mechanism such as "Start Trial," "Purchase Report," "Order Now," or "Register," constitutes your legally binding electronic signature and forms a legally binding agreement between you and us.

    18. Governing Law; Venue

    These Terms and any dispute arising out of or relating to the Service or these Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules.

    To the extent any dispute is permitted to proceed in court, you and we agree that exclusive venue and jurisdiction shall lie in the state or federal courts located in Wyoming, and each party irrevocably submits to those courts.

    19. Changes to Terms

    We may modify these Terms from time to time. Updated Terms become effective when posted, unless a later effective date is stated. If we make material changes, we may provide notice by updating the "Last updated" date, posting notice on the Service, sending an email, or by other reasonable means. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms.

    20. Miscellaneous

    These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior or contemporaneous understandings on that subject.

    If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be enforced to the maximum extent permitted by law.

    Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in whole or in part at any time. Section headings are for convenience only.

    Appendix A: NMVTIS Consumer Access Product Disclaimer

    The National Motor Vehicle Title Information System (NMVTIS) is an electronic system that contains information on certain automobiles titled in the United States. NMVTIS is intended to serve as a reliable source of title and brand history for automobiles, but it does not contain detailed information regarding a vehicle's repair history. All states, insurance companies, and junk and salvage yards are required by federal law to regularly report information to NMVTIS. However, NMVTIS does not contain information on all motor vehicles in the United States because some states are not yet providing their vehicle data to the system. Currently, the data provided to NMVTIS by states is provided in a variety of time frames; while some states report and update NMVTIS data in "real-time" (as title transactions occur), other states send updates less frequently, such as once every 24 hours or within a period of days. Information on previous, significant vehicle damage may not be included in the system if the vehicle was never determined by an insurance company (or other appropriate entity) to be a "total loss" or branded by a state titling agency. Conversely, an insurance carrier may be required to report a "total loss" even if the vehicle's titling-state has not determined the vehicle to be "salvage" or "junk." A vehicle history report is NOT a substitute for an independent vehicle inspection. Before making a decision to purchase a vehicle, consumers are strongly encouraged to also obtain an independent vehicle inspection to ensure the vehicle does not have hidden damage. The Approved NMVTIS Data Providers (look for the NMVTIS logo) can include vehicle condition data from sources other than NMVTIS.

    NMVTIS data INCLUDES (as available by those entities required to report to the System):

    • Information from participating state motor vehicle titling agencies.
    • Information on automobiles, buses, trucks, motorcycles, recreational vehicles, motor homes, and tractors. NMVTIS may not currently include commercial vehicles if those vehicles are not included in a state's primary database for title records (in some states, those vehicles are managed by a separate state agency), although these records may be added at a later time.
    • Information on "brands" applied to vehicles provided by participating state motor vehicle titling agencies. Brand types and definitions vary by state but may provide useful information about the condition or prior use of the vehicle.
    • Most recent odometer reading in the state's title record.
    • Information from insurance companies, and auto recyclers, including junk and salvage yards, that is required by law to be reported to the system, beginning March 31, 2009. This information will include if the vehicle was determined to be a "total loss" by an insurance carrier.
    • Information from junk and salvage yards receiving a "cash for clunker" vehicle traded-in under the Consumer Assistance to Recycle and Save Act of 2009 (CARS) Program.

    Consumers are advised to visit vehiclehistory.gov for details on how to interpret the information in the system and understand the meaning of various labels applied to vehicles by the participating state motor vehicle titling agencies.

    Appendix B: NVS Data Disclaimer

    The ultimate source of the lien information available through ClearVin vehicle history reports is provided by the National Vehicle Service (NVS). Although every effort is made to ensure the accuracy of transmission and data, the reports are provided "as is." Some lien holders and jurisdictions do not report to NVS. Records from NVS may be incomplete. ClearVin makes no warranty either expressed or implied as to the validity of the NVS data. Other than that, data provided is a true and correct reproduction of the NVS data.
